Well, Why Chat will certainly have a better idea but, I'd find a lawyer I was comfortable with and make sure the TILA is introduced where it specifically defines a cc debt as an open contract. Maybe you'll get lucky the first time but, I think you'll probably need to appeal to a court with a more formal setting to get that argument recognized.

I'll revert to my post from yesterday. It looks like the lawyer who sued you has praticed in this venue and knows what the judge will accept. The first lawyer you spoke with has probably been on the receiving end of some of those rulings and knows this judge will take into consideration that this is your debt. He/she is really trying to defend you to the best of there ability and part of the stragedy has to be anticipating the way the judge will rule based on their experience in praticing before him.
