If the doctor has a contract with your insurer, s/he is usually bound to submit claims within a certain time period (60, 180 or 365 days). If the claim was submitted late, the patient cannot be billed. However, if the doctor is not contracted or if the contract does not have a filing limit (poorly written contract), then the SOL for that state applies. Contact your insurer immediately. (I work for an HMO. Some doctors and hospitals are so disorganized that they submit many claims late. Saw one from 1994 the other day.)
