"POOR" lawyer-is living up to his name. It is illegal in ALL States to file a lien on a homestead that is jointly owned if only one party is on the judgment. NOW, if te proerty is to be sold, or financed . that judgment would have to be satisfied to provide clear title.So, to that extent, it would be an encumberance on the property.
