I have seen too many horror stories about people who use post dated checks or checks over the phone. collectors have been known to take that check and cash it a few times over or jump the gun on the post dated check. Sure it is illegal but as you point out most people do not do anything about it. If I owe $200 and you take a check for $50 over the phone I am gonna find that $50 check cashed 4 times.
