Here's the letter I sent certified mail last week. They replied this afternoon - 15th. With reference to my phone conversations on August 5 and August 6 with ***, please note I have been paying portions of the special assessment in the checks I have sent for my regular dues. „h In June I sent in a check for $600 (approx., $400 of this was for the special assessment) „h In July I sent a check for $400 (approx. $200 of this was for the special assessment). „h I also faxed a letter to the association (and have the fax confirmation that it was received) explaining I was in the process of trying to refinance at the time and that the special assessment would be paid in full once the process was completed. Regardless of refinancing, I have been paying contributions to this special assessment every month. This surely shows intent and goodwill to pay. The approx. amount of the total assessment is $1100 if I recall correctly. This means I have only $500 to pay to fulfill the total obligation. *** mentioned that one of your attorneys dropped of a letter in the door of my home a while ago. I do not recall that letter and the fact that my situation has been forwarded to your attorneys was first learned by me during my conversation on the 5th with ***. I find this a totally unnecessary move in few of my proven intent to pay. If the situation had been different, i.e. ˇ§no intent to payˇ¨ then it would be more understandable, but this is not the case as you can surely tell from the payments I have made. I plan to make sure the balance ˇ§of the remaining special assessmentˇ¨ will be paid to you by the middle of September and will make payments as I have done the last two months. My employment situation is ˇ§changing statusˇ¨ and during this period I am not drawing an income for a two-week period. Your understanding of this situation is requested during this time without the very unecessary cost of attorney fees. I would appreciate a written AND emailed response to this letter by the close of business on August 14.
