I can only assume that the CA is stating that if you refuse to deal with the situation via phone or mail, then you leave them no recourse but to file suit. Its not like you can send them a C & D letter and poof your troubles are gone. If the CA decides to file suit, then by law they have to send you a letter letting you know they've decided to sue. A letter will follow from their attorney and will have the mini-maranda statement on it, giving you one last chance to dispute or settle the debt. However, they can and probably will continue forward with a suit.

As Why Chat stated, the best thing to do is deal with the phone calls and bide time.
