My husband and I have a court date with Discover for a debt. We also have a few charge offs. They have gone to collection agencies who are sending us letters. We spoke with an attorney and he said to file bankruptcy. But I have heard conflicting stories about the charge offs and collection agencies. Will filing for bankruptcy stop the collection agencies and wipe off the charge offs? Would we be better off trying to pay Discover before the court date and not file for BK? I am just worried about the possibility of a lawsuit from one of the CA. Those other debts are older (1 1/2 years) than the Discover debt. One debt is $2000. Either way, we are going to have to borrow money from family to pay the lawyer or Discover. What would be the best thing to do?
