Your credit is going to be ruined either way. If the lawyer you spoke with did not make you feel comfortable, speak with another one. Having collection agencies after you is miserable, it can affect your health your job, your marriage, you name it.

An attorney can tell you whether you qualify for bk or not, but it is your decision alone. Generally speaking, if you cannot pay the debts, and don't file bk, you will be dealing with them for years and years to come, since collection agencies sell them over and over Many CA's re-age them so they can put them back on your credit report, years later, trying to make you pay them. Read some of the CAMCO posts on here. These debts are very very old. Hard to believe that these slugs will not leave people alone after all these years. Do you want to be one of those?

Also, the bk laws are changing, so you don't have a lot of time to dawdle around - go talk to another lawyer.

Keep in mind that everyone has a point of view, and some have an agenda. Find an attorney who listens to you, but make your own decision.

I have been through bk (not because of consumer debt). The only thing I felt afterward was relief!! It was over. I was free. But it is a public record that will always be there. It does not cause me any problems now, but I had it on my credit report for 10 years.

personal rant:
I think that was a severe punishment for someone who had lost a spouse and could not pay medical bills afterwards, and I *could* let the bitterness take over my mind. People can talk all they want to about being prepared, blah blah blah - there are things you cannot prepare for - like a fatal illness at age 44, and insurance running out. That is why I help people whenever I can - it is something constructive that has come out of my experiences.
