Definitely see a lawyer - the fact that this has screwed up your mortgage give you reason to sue. As far as not applying for anything - I disagree. To sue you need damages and you need someone besides yourself viewing that report, and you need to be turned down or offered a higher rate than you would have gotten if this information had not been on your reports.

This is extortion, pure and simple.
