So what is the proper term, when there is no jury and the judge tries the case? I know the homonym might be in camera ...

MOST IMPORTANT question, would a case suing or countersuing for a specific violation such as litigating a debt where SOL had expired be tried by jury?

Not that voir dire (truth telling) selecting a jury would ever net a jury of our peers, we would most likely wind up with a panel of small business people who had been driven out of business because of uncollected debt and are therefor free for jury duty ...

... but which would be most likely to be desired by plaintiff, historically, if you are aware of any, IF there is a choice?
