The thing is, according to the FDCPA, they cannot threaten to sue without actual intent to do so ! If they make the threat, w/o intent, ask them for the exact date that the suit will be filed and all the details. I'd bet they won't or can't do it, in which case they would be in violation of the FDCPA. At least, that's the way I read it.
