It is easy for a judge to rule whatever way they want to,the laws on contracts are complex, and most lawyers and most lower court judges have had little practice in the subject of Federal laws and rules and definitions overriding State laws.PLUS the fact that it is an "open account" does not by itself mean it is considered one way or another in State statutes on SOL. The legal definitions in STATE laws must be cited.
