I do believe he said that the SOL had to be raised in the ANSWER to the complaint plaintiff filed

We are NOT in small claims court here when we are being sued for the most part, except maybe the guy Cavalry is after for $69. And even there our ANSWER is that although other means of collecting the money at issue, which we may or may not owe, litigation as a means of collection is prohibted by ________ of FDCPA.

We really really need to MODEL cases and court protocols somewhere, on critical points of presentation as well as case law.

Because no matter how neat and orderly your argument is, if you have WAIVED some privilege or defense UNintentionally or UNknowingly, well, you've done it, and there you are -- with an absolute defense you can not use.

We need to see how our winners won, and how our losers lost.
