Yes, thats right, meux may have already waived the SOL defense.

However, I think he said he made a personal appearnace instead of an answer, so he might be able to assert the defense still.

And also, a judge with a per se litigant will often cut them some slack on the technical procedure rules.

Also, in SC where I'm at, small claims court, i.e. Summary or Magistrate Court, is for any suit in which damages are $7500 or less. Most all credit card suits in this state are done in Summary Court in front of a magistrate.
