He could have disputed it with the OC under TILA, he can still dispute it in his answer to the lawsuit. None of his FDCPA "rights" have been taken away as it was never in a ca's hands for COLLECTION purposes.
Which is why the lawyer never contacted him for collection, as that WOULD have put him within the FDCPA rules.
