They are requred by law to identify themselves as a debt collector, they are required by law to state "this is an attempt to collect a debt". This was established in prior caselaw,even though they are not actually engaging in any COVERED collection activities. Filing a lawsuit is exempt from the definition of collection activities, as is the notice of filing, as is the serving of papers.The reason you haven't heard from them before, is, as I said, they DO NOT wish to have their actions fall under the FDCPA requirements.
