Yes, if they were unable to validate, you ca answer their lawsuit with a claim that they have no proof the debt is yours, that you attempted to obtain proof of the obligation, and they do not have it.

If, on the other hand, you requested validation on a provable debt, within SOL, you have shot yourself in the foot.
