Yes, it's me again! Well I searched and searched and found the section that excludes lawsuits, summonses, etc. from being considered "communication". So I've finally gotten that through my thick head. Now -- what about a letter from this same collection attorney that was received a couple days after I got the summons? Is that letter considered a first COMMUNICATION and therefore subject to the FDCA regulations regarding validation, 30 day notice, etc.? Or once I've received the summons are all subsequent communications excluded from the FDCA. The letter basically identifies the coll. attny as the attorney for the CA and that they were notified that I received the summons and if I wish to discuss the matter to avoid further legal proceedings I should call him.
