and you recieve about half of your income from social security and half from a job can they touch your checking account at all or can they garnish your wages? (not sure if it matters but the social security is for the surviving children of their decieced father). THis email is a continuance of one last month, I copied it here incase you need more info:

I am writing this for my sister who does not have a computer so please bear with me. Here is some quick history: She was a single mom and had a grand am financed but she was not carrying insurance. The creditor put it's own insurance on the vehicle but was tacking that onto her bill also. So she would pay longer than normal for the car. Her last payment should have been in September of 98 but she continued to pay until January of 99 (for the ins). She quit paying when she was in an accident and the insurance would not pay when the car was totalled. She was having to pay that insurance that the creditor put on the car but it did not pay when she was in an accident so she stopped paying. The original creditor charged off the amount in january of this year. Now a collection agency named "C U Recovery" which is an assignie of "Members Cooperative Credit Union" is taking her to court for 3000 dollars. She has her original agreement. What would you suggest she do? Thanks in advance for your help and if I was not clear or you need more info. please let me know. Darry30

What state? What is the $3,000? Insurance premium? loan balance? deficiency balance? Have they told her what it is supposed to be for? What was the premium on the insurance?

That kind of insurance only pays the lender, even though your sister was paying for it, she was not insured by it, the lender was.

it was 500 dollars a year for the insurance and they paid that for two. And the loan itself was 2300 which was the balance and then the rest of it was interest that is still acrueing. I was mistaken on the car being totalled. It was in a wreck and the ins would not pay to fix it and she could not afford to get it fixed so she ended up getting another car and did not pay the balance of the rest of the loan. The ins was added on to each payment by 30 dollars. Is there anyway to fight this? also , it was in MN where it all happened. thanks in advance
