Yes, Federal law pre empts any State law, yes cc accounts are open-ended contracts, yes the law is on his side. HOWEVER, many small rural County civil courts have judges who are appointed,and many not even be lawyers, and they listen to lawyers because they themselves do not know, and won't bother to learn, the law.
