I agree, that is pretty good validation. If they sue they will win. Just because you or your wife didn't sign anything regarding payment, you did sign a consent to treat, which in a nutshell suggest that in receiving this treatment you will be responsible for payment, you didn't assume it would come free?

Also, I would suggest making a lump sum settlement. $400, isn't bad to start with. However, I'd try to settle for the principal balance and see if they'll eat the interest. In your settlement agreement make sure you have them sign and return and letter to you stating that once final payment is received, they will delete their entry from your credit report. GET IT IN WRITING! And, don't send any money until you do. Keep copies of outgoing and incoming correspondence and don't get discourage if they reject your first offer.
