I saw in a reply you posted last month on this thread: http://www.cardreport.com/wwwboard21/messages/11961.html You posted :"From what I see in summary for one case in Ohio, when the "time-barred from litigation" or perhaps some other issue but probably not was raised in a case (I do not have transcripts so I am only guessing here), if SOL is PROPERLY raised as a defense (see poor lawyer's cautions on various LOGICAL BUT DEADLY legal maneuvers), it seems they can't get the information, and at least one judge dismissed in favor of defendant BUT ALSO allowed 30 days for the plaintiff to file again" Do you have a link or information about a case in CC Ohio that was won by the defendant on a SOL defense? My case has been sceduled for trial in a few months and I'm wondering if there was anything about this case that could be helpful. Since Assinine Acceptance stated in their complaint that "the original copy of the application has likely been lost or destroyed..." I'm wondering if I should file for discovery before the trial to see if the original app with a signature still exists so I'll know that before I go in front of the judge.
