When a defense to an action is raised, unless the plaintiff just doesn't appear, the Court will usually dismiss the case "without prejuidice",or hold it over for (usually 9 days). This gives the plaintiff time to reopen with a rebuttal to the defense. After 3 months (usually) you can petition for a dismissal WITH prejuidice,this means they cannot re-open the case.
