1099C and continued late fees

If a creditor accepts your settlement offer should the 1099C be included with their agreement? If you haven't actually paid them yet (fulfilled your part of the agreement) how can they issue the 1099C? Should the taxes be paid before the creditor or just wait til you file your income taxes since you have the 1099 in hand?

Also, if a credit card company has closed an account because of late payments and being over the limit can they continue to charge late fees, over the limit fees, and interest?
