Was the finance co. loan for a purchase of a household item?
If so, it would fall under the 4 year UCC Ohio "sale of goods"and not the 15 year written contract.
In geeral, it would be VERY difficult, in my opinion for a collection agency to actually file suit on anything, even an actual written contract,after this long a period of time.If you have been contacted recently by a ca who says they are "filing suit" I would have to guess they have no ability or actual intenton to do so.
If their only contact with you has been by phone,th next time they call, get their name and address if you can and request validation, with documentation of a copy of your original signed contract and proof of their ownership of the account.
As to your credit report, all derogatory information must be removed after 7 years from chargeoff, (pre-1998) or first delinquency(post 1998) It can not be legally re-entered or re-aged.
As to "legal advice" on the forum,people have a tendancy to put too much faith in free advice. If you go to my website, you will see I only warrant the infomation on Government Websites.
