I am comptempleting Bankruptcy soon. I am 28,000 in debt. All the debt is in my maiden name. I got married last Feburary and my husband has no debt. The only assets I have is my car and house which I bought last year, I have no equity in it. My car has a lein on it for 5,000. Now I thought that Chapter 13 would be for me, but after spending hours reading through the board on BK, I am now thinking that maybe Chapter 7 is more to what I need. Here are my questions. I am in Kentucky which is a community property state.

1. On Chapter 7 is there any way to keep the house and car?
2. When filing Chapter 13 or chapter 7 how long is the process from beginning till end? Wondering if it is months or weeks.
3. I had heard that you can keep a car if it is the only one you have. Now does that mean even if it has a lein on it through a creditor? Just wondering.
4, Can I file myself and my husband be free of harrassment or liabilty?
I am going to talk with a local attorney in the next week but wanted to get everyone's input on this since it is such a big decision.
Thanks to all who post, I have learned so much from the board. Wish I would have found this board ages ago.
Millie
