If your insurance company had a contract with the hospital, there is usually a provision that the hospital bill the insurer timely and does not have recourse against you if the insurer does not pay. However, if you did not provide timely insurance info to the hospital even after receiving billing statements, you would relinquish that protection through negligence.
I work for a Calif HMO and have seen several cases where persons ignored billing statements under the false assumption that the medical provider had psychic powers enabling them to bill the proper insurer. 2-3 years later we get a call from the insured when it hits the credit report. At that point... too bad, so sad. Even the best consumer protection laws on the planet will not save the person who does nothing to save him/herself.
