PLATES: Remain with debtor In general, if the law on repossession was not followed, the finance co or lender has no claim to a deficiency judgment-so if someone puts a collection account on your credit report, or tries to collect, and you did not have a legal repossession and notice of resale, their claim is not legally enforceable. If everything was done legally, and you are in Fl. then it is 5 years for being sued from the date of the deficiency occurance.
