If it really matters, send a letter CRRR demanding to know why you were declined. Personally, I'd let it go and proceed with your real estate closing. Forgey about damages with that 1/8 of a point. The average person stays in a home for 7 years. Plus,everyone who has ever financed a home can point to a "if I had done it then" I'd have saved an 1/8 or, a 1/4. Besides, if they did find something they didn't like in your credit report and let you know, you'd have spent a month at least trying to get it fixes. I just doubt you have any traction to claim damages.
