Bank of America account turned over to attorney

We have 2 separate bank of america accounts, one with a 9,000 balance and the other with a 4,000 balance. We were contacted by an attorney today, saying that they were going to sue if we didn't come up with the money to pay these. We have worked with B of A in the past, but were unable to settle due to lack of funds at our house closing.

We are in Alaska, and the original accounts were opened in Washington state. We stopped making payments in 1999, but have made subsequent hardship payments in the last few months, and now are no longer able to to that.

What are the laws regarding suing people who are in a different state? Do they need to do it in the state that the people (us) live in? Or can it be done long distance.

The woman on the phone said, make no mistake B of A does sue people. I am just about ready to throw in the towel and do Chapter 7. Has anyone else dealt with Bank of America or the law offices of Fred Hand (Han???) to blurry on the recording and associates.
