If the FEDERAL TILA defines credit cards as open accounts, even if the State law agrees, then doesn't the FEDERAL law trump the state law anyway ? I would think the best defense against this would be to go to court with copies of the TILA and the applicable State laws and speak up. Hand the judge and the opposing lawyer copies of the Federal law sections and let them read it for themselves, they can't deny it !
