I recieved a summons today from Asset Accept Corp. From all that I've read here on board, it seems typical to recieve this even if the sol is up. It's a real summons to appear for pretrial conference. It was delivered by what appeared to be an ordinary person but it has case# and date/time to appear at courthouse. The last page states the following: assignee of : Chase my name & address Asset Accept Corp acct# Original lender acct# purchase date 3-19-01 princ amount $1708.00 interest due 573.99 total balance 2282.14 interest rate 12% date of chrg off 4-26-98 Date last payment 11-17-99 Dated this 4th day of Sept 2002 Nevada Corp doing business at PO Box 2036 Warren MI 48090 (Who is Nevada COrp?) I recieved a summons back in 99 from a different collector representing CHASE and agreed to make 2 payments of $600 to settle debt. I dont think I signed anything. This was all over the phone. I paid $600 but then couldnt make the 2nd payment. didn't hear anything else about it. Then Asset got it and from my CR it appears they have been 'looking for me". Now here we go again except I think I'm past the sol and don't want to make any attempt to pay if it's not going to make a difference on my CR anyway. besides the fact that I cant afford to make any large payments. Here in Fla. I think I can count SOL from when I went into default which is way before the last payment in 99. Do these people really take it this far just thinking I won't use the SOL in my defense? If so, what exactly would I take as proof of SOL? Would a copy of my CR be enough to show when I 1st defaulted? I might as well forget about that $600 going towards to balance. It doesn't appear to have been applied. Thanks so much for the advise :)
