The law is only as good as those who defend it.
The simplest (and kindest) answer is, that the lawyers and judges in the lower courts are completely unfamiliar with Federal laws such as the FDCPA and the TILA,since what their normal practice is just very low level, simple State law. Traffic offenses, dog bite cases etc.

I have prepared a generic form to use to "prove" that credit cards are open accounts in those areas and in those situations where the CA's are taking advantage of the lack of familiarity with the Federal laws.

It will involve some research for those State's I haven't yet researched for the applicable statutes,I should have most of it done in a day or 2,if I don't get called back to work.
