"Observer" was referring to a specific question on a newly defaulted account, not making a general statement. If you go to my website I have a link to the rules that creditors must follow in "writing off" or "charging off" accounts. This has nothing to do with the actual ownership of the account.

In your case, as it will be soon in the case of the poster he was answering, the account WILL be first assigned to an outside collection agency, then it may be either acted on by the creditor's legal dept. or SOLD to another collection agency.

Sears may or may not have some record of your accounts in their computer system,but since the account was sold to a collection agency, they are precluded from dealing with you by virtue of their contract with the ca, whom they transferred copies of your records to.
