The answer to the Pep Boys question is a typical attorney answer, "It depends". As a generalization, if the check wasn't paid, they should still have possession of it. Therefore, proof that it wasn't paid. Could they have an acceptable answer as to why they don't have possession? Possibly. You should also be able to get your records to prove that it was paid. Do you have an acceptable answer as to why you can't? Possibly. So, you see, it depends.
