If they are offering you a 50% settlement, and it is from a collection agency, it is probable that you are beyond the time limit for the debt to be legally collected. What State are you in, and when did you first default, (have your first "late" or "past due" notice from Capitol One? In general, however, if you make a "settlement" of any kind with one collection agency, then the unpaid balance gets sold to another collection agncy,who then starts to try to collect that amount from you.
