Burton i wrote about the arbitration stuff like maybe a week ago , MBNA is the grandfather of this arbitration nonsense & MBNA account holders that were not in default before 2000 will be the 1st to have to deal with this stuff like yourself .. most people still are clueless of this & guess just wanna bury their heads like its not really there but the fact is MOST card holders NOW are subject to binding arbitration & dont even realize it becouse the major cc companies sent amending agreements in their billing statements within the last 12 months .. i wanna make this clear im by far no expert on this matter & this applys to personal accounts BUT my suggestion to you is IF you dont have many or any assets id say do nothing right now ( only becouse the new BK bill is dead for most likely another 18 months ) & see what their next move is & at that time if they do go to arbitraton which they may or maynot( they'll win 98 % of the time ) & win id than at that time file for bankruptcy .. this new arbitrition is still subject to states SOL laws IF they do not go to arbitration before the SOL expires in your state & from what im understanding if you own a home or have assets bank on it cause their going to arbitration but if not well thats still an open question , talk to an attorney ... goodluck , kelly ...............
