You need to understand that ALL of the case law so far on this subject has nothing to do with debt collection.
Compulsary arbitration in credit agreements -as in all other contracts, are designed to keep the CREDITOR out of court in things like class action suits etc.
The fact that one unscrupulous law firm is using the confusion on the subject to harrass and bully debtors is just another tactic that can be overcome by anyone who is protected by the FDCPA.Unless and until the FTC and State laws are clarified, these defenses are going to have to be done the hard way, much more difficult than defending a past SOL lawsuit, but they can be successfully fought.However, by the time someone finds a lawyer to help them,it may probably have already gone to judgment.
