misty , just stay calm becouse i highly doubt you'll get served at least anytime soon so relax .. tell ya what "i would do if it were me " id get caller ID so you can screen you calls so you control your phone & dont let your phone control you and absolutely do not talk to them on the phone im sure they'll send you enough collection threats through the mail & just let them do that cause it makes THEM feel like their making you scared when in reality its just a waste of their stamps paper & time but let the feel like their the bigshots lol .. usually the actual credit card company will try to collect for maybe about 5 - 6 months then you'll most likely hear nothing for a couple months than it'll start all over again once they sell the account to an outside collection agency but honestly living in north carolina is to your benefit becouse they can only win a suit against you for 3 years there cause thats the nc statue of limitations in your state but it will still remain as bad credit on your credit reports for 7 yrs from when you stopped paying .. i think you said you have no assets so id think your safe from being sued but if you ABSOLUTELY cannot pay off the card via arangements than "if it were me id do nothing & wait & see IF they sue , 3 yrs is along time but its not forever .. just my opinion but we all need good credit in life so if theres anyway to avoid all this i personally would try to but i understand people have tough times when in reality it cant be helped either .. good luck kelly .....
