Your first question has some thing missing. No an attorney does not need a contract, its not smart, but no its not needed in most states. But an agreement is needed. That could be as little as the plantiff SAYING, TELLING that he wanted the attorney to make a phone call for him, or make a request of the attorney through jail house bars.
