The loan was written down and signed by both my ex and I. The date was Oct 10, 1996. I was served papers this morning dated Oct. 9, 2002 stating that I need to respond within 20 days or a judgement by default will occur. I made two payments of $1,000 each two years ago. Then, my divorce came thru and wiped me out financially. They sent me a letter saying not to worry about paying...and yes, I have that letter. Also, at the time of my divorce I went to them to "seperate" my portion of that loan from what my ex borrowed (a lot of his borrowing I had no knowlege of....) At that time (Oct. 2000)a new paper was written up with the amount that just I owed and signed by both of his grandparents. The old original loan "grandpa" wrote up included 10% interest plus 5% of profit from my store. The new paper at time of divorce does not include the interest or 5%. They said that they would let that go, at that time. Now, this legal doc. requests the interest for 6 years plus 5%!! Their lawyer told me that it "appears' to be their signature, but they don't recall signing anything like that. Yes, I have the original signed doc. in a safe deposit box along with the letter saying not to worry about paying till I get on my feet. By the way, my ex was a real smooth crook. He forged my name on loans, stole credit cards...VERY deceitful. When he walked out, he left me with a mortgage debt of $10,000 and many more unpaid bills...needless to say, it's taken all of these two years to catch up! That's why I divorced him. What about SOL....one day? It is six years in the state of MN.
