SOL and court dates anyone know???

quick question I am wondering when the SOL date is in effect. If the SOL is in effect in October (6 years) and CA files papers for a suit in September (5 yrs/11months), but the court date is in November are they still in their means to collect, or does the consumer have a SOL defense on that court date in November. Just courious how this would play out.
