I'm not sure it's illegal but, it sounds like the merchant violated their agreement with Visa/MC. Call the cc company and complain. If you get no satisfaction, ask for a contact number for Visa/MC and file a complaint with them.
The problem you may have with the cc company is the FCBA requires you to file a complaint within 60 days. Good luck and post your results. Also, you might post this at www.creditnet .com. There was athread there several weeks ago about some retail merchants requiring a minimum amount to use a charge card in violation of there agreement.
