Does your cardmember agreement say that this car is governed by "such and such state" law ? If so, go by that statute of limitation. An attorney told me this. If this card is goverened by another states law then that's the statute of limitation that applies. I hope your card was issues from a bank in Deleware or something since they are olny valid for 3 years or so. Good Luck
