Don't sweat...you have things in your favor. Most of your debt to sears is probably fees and interest, which could be knocked off in a lawsuit. It would help your case if you did appear. Your state will indicate what percentage of your pay can be garnished if any and what personal property exemptions you have.. Even if they win the lawsuit (and they probably will) They will need to request a garnishment in a separate hearing. Depending on how bad your situation is ( you sound kinda desperate)..you also have bankruptcy on your side...if you haven't thrown that in Sears face yet..do it now. The cost of suing you if they know it will be erased in bankruptcy probably won't be worth it to them. Just a reminder judgement = 7 years...bankruptcy= 10 years.
