Did you send in your validation demand letter to this 'lawyer' ? If so, then you are correct, they cannot sue you before validating.

However, if you didn't ask for validation, they can sue you whenever they feel like it.

There is a website where you can look up this attorney and find out what their primary business is. I'll have to look it up and repost (thought I had it saved)
