The statute of limitations for credit cards in Fl. is 4 years. You can claim an affirmative defense in Court that the lawsuit is time-barred. You can go to my website for information on how to answer a time-barred lawsuit. If it is small claims court, you need not file an answer, just be prepared to claim the affirmative defense of it being past SOL.
