I didnt have mediation before the trial. I was offered the opportunity by the lawyer, but didnt reply. I think that's a tactic to see if the Summons scared you.
I saw people in the courtroom called ahead of us who answered "no" when asked if it was their debt. Then the judge sent them and the lawyer with a mediator outside the courtroom and they'd come back in 10 minutes later and be called back up again to say they reached an agreement. One guy came back in and when called up, stated they HADNT reached an agreement so the judge set a trial date for them.
I didnt have a trial date set. The judge just told the lawyer to contact me if he could prove otherwise making it sound like the judge doubted he'd see us again.
So if you've already tried mediation then I guess you'll go the next step to trial and then do the same thing I did. Send the letters that whychat has under "how to answer a summons". I did all that thinking I was summoned to trial but it was a PREtrial. But it worked out for me anyway. I think skipping mediation made it simpler for us.
Was mediation offered and you accepted?
