RUN, don't walk, to a good IA consumer lawyer. From what you've described you've got a great FDCPA claim against the debt collector. FDCPA calls for attorney fees for the consumer's lawyer if he wins, so it's worth checking out. Sounds like the makings of a good class action suit too. Consider suing the original creditor for abuse of process. Depending on the exact facts, that might be a winning argument. The IA lawyer can tell you. The original creditor will probably fire the debt collector.
