Yes it is POSSIBLE that they will sue, although from the type of tactics used it is likely a "bottom feeder" collection agency.

These usually only acquire "stale" accounts that are beyond the legally collectible statute of limitations.

If he had been paying to a ca on a legally collectible account they would not be trying to extort more $$ from him, and would have given him a proper accounting of his payments.
